Terms and Conditions for 'DrTop Entrepreneur'
These terms and conditions (“Terms”) govern your participation as a 'DrTop Entrepreneur' by words & means define as a sales agent for getting doctors registered for the DrtoP & DrPET Online software platforms owned by Tertiary Care Pvt. Ltd., offering telemedicine application utility to Doctors & Patients. By registering as a 'DrTop Entrepreneur', you agree to comply with these Terms:
1. Registration Eligibility:
1.1. You must be at least 18 years of age or older to register as a DrTop Entrepreneur.
1.2. You must provide accurate and complete information during the registration process.
2.1. As a DrTop Entrepreneur , you are responsible for promoting DrtoP & DrPET Online to doctors and encouraging them to register on the Platform.
2.2. You agree to conduct yourself in a professional manner and represent DrtoP & DrPET Online accurately and positively at all times.
2.3. You will not engage in any deceptive, misleading, or unethical practices to register doctors on the Platform.
3.1 Registration as a DrtoP Entrepreneur will be done by such interested individuals by filling in the online registration form furnishing all their contact details, age, qualification, references as well as their bank account details and also formally agreeing to the terms & conditions as laid down in this document.
4. Training:
4.1. All Drtop Entrepreneurs thus registering with Tertiary Care Pvt. Ltd. will have to undergo an online training & orientation program conducted by Tertiary Care Pvt. Ltd..
4.2. Tertiary Care Pvt. Ltd. reserves the right to charge a nominal fee for such training events as deed fit.
5.1. Tertiary Care Pvt. Ltd. will pay you for your efforts based on the number of Doctors you get attached to the DrtoP & DrPET Online platforms.
5.2. For every Doctor added to either of the platforms, DrtoP Entrepreneur will ensure that Rs. 10,000/- is paid by them to Tertiary Care Pvt. Ltd..
5.3 For every such Doctor added due to the efforts of the DrtoP Entrepreneur, Rs. 2,000/- will be paid to the registered bank account of the Drtop Entrepreneur.
5.4. The remuneration to the Drtop Entrepreneur will be made after successful onboarding of the Doctors & receipt of their full payment at Tertiary Care Pvt. Ltd..
6.1. Tertiary Care Pvt. Ltd. may offer incentives to DrTop Entrepreneurs based on more number of doctors successfully registered through their efforts.
6.2. The details of the incentive program, including eligibility criteria and incentive structure, will be communicated separately and are subject to change at Tertiary Care Pvt. Ltd.’s discretion.
6.3. Tertiary Care Pvt. Ltd. reserves the right to modify or terminate the remuneration and/or the incentive program at any time without prior notice.
7.1. You agree to maintain the confidentiality of any proprietary information, including but not limited to trade secrets, business strategies, and customer data, obtained during your participation as a DrTop Entrepreneur.
7.2. You will not disclose or use any confidential information for any purpose other than promoting DrtoP & DrPET Online software platforms.
8.1. All intellectual property rights, including trademarks, copyrights, and patents, related to DrtoP & DrPET Online and its services are owned by Tertiary Care Pvt. Ltd. or its licensors.
8.2. You are granted a limited, non-exclusive, revocable license to use DrtoP & DrPET Online’s intellectual property solely for the purpose of promoting the Platform in accordance with these Terms.
9.1. Tertiary Care Pvt. Ltd. reserves the right to suspend or terminate your registration as an DrTop Entrepreneur at any time and for any reason without prior notice.
9.2. Upon termination, you must immediately cease all promotional activities related to DrtoP & DrPET Online and return any materials or resources provided by Tertiary Care Pvt. Ltd..
10.1. To the fullest extent permitted by law, Tertiary Care Pvt. Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation as a DrTop Entrepreneur on the Platform.
10.2. Tertiary Care Pvt. Ltd.’s total liability under these Terms shall not exceed the total amount of incentives paid to you, if any, during your participation as a DrTop Entrepreneur .
11.1. These Terms shall be governed by and construed in accordance with the laws of Ernakulam, without regard to its conflict Tertiary Care Pvt. Ltd. of law principles.
11.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ernakulam.
12.1. Tertiary Care Pvt. Ltd. reserves the right to amend or modify these Terms at any time by posting the amended Terms on the Platform.
12.2. Your continued participation as a DrTop Entrepreneur following any such amendments shall constitute your acceptance of the modified Terms.
